The case studies highlight a situation, as well as the questions raised, and the policy implications for any outcome. Each case demonstrates the trade-offs implicit in nearly every decision or setup.

     

    These case studies may also be helpful for trust and safety professionals as a training tool, and as a way to look up and compare past examples that may have some resonance for current challenges.

AGREEMENT TO TERMS
 
These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Trust & Safety Foundation Project of the Internet Education Foundation’s (“TSF”, “we”, “us”, or “our”), concerning your access to and use of the tspa.info website ( the “Site”). 

BY ACCESSING OR USING THE SITE, YOU AGREE THAT YOU HAVE READ AND UNDERSTOOD, AND, AS A CONDITION TO YOUR USE OF THE SITE, YOU AGREE TO BE BOUND BY, THE FOLLOWING TERMS OF USE. 1. ELIGIBILITY

You must be at least 18 years old to use the Site. By agreeing to these Terms of Use, you represent and warrant to us that: (i) you are at least 18 years of age; (ii) you have not previously been suspended or removed from the Site; and (iii) your use of the Site is in compliance with any and all applicable laws and regulations. If you are an entity, organization, or company, the individual accepting these Terms of Use on your behalf represents and warrants that they have authority to bind you to these Terms of Use and you agree to be bound by these Terms of Use.

The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Site from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable. 

2. LICENSES

Subject to your complete and ongoing compliance with these Terms of Use, TSF grants you, solely for your personal, non-commercial use, a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Site. Except and solely to the extent such a restriction is impermissible under applicable law, you may not: (i) reproduce, distribute, publicly display or publicly perform the Site; (ii) make modifications to the Site; or (iii) interfere with or circumvent any feature of the Site, including any security or access control mechanism. If you are prohibited under applicable law from using the Site, you may not use it. 

3. INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Site and any content it contains (the “Content”) is our proprietary property and the trademarks, Site marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United States, foreign jurisdictions, and international conventions. Except as expressly provided in these Terms of Use, no part of the Site and no Content or Marks may be used or distributed without our express prior written permission. TSF reserves all right in and to the Content and the Site not granted expressly in these Terms of Use.

4. FEEDBACK 

If you choose to provide input and suggestions regarding problems with or proposed modifications or improvements to the Site (“Feedback”), then you hereby grant TSF an unrestricted, perpetual, irrevocable, non-exclusive, fully-paid, royalty-free right to exploit the Feedback in any manner and for any purpose, including to improve the Site and create other products and Sites.

5. THIRD-PARTY WEBSITES AND CONTENT

The Site may contain (or you may be sent via the Site) links to other websites (“Third-Party Websites”) as well as articles, photographs, text, graphics, pictures, designs, music, sound, video, information, applications, software, and other content or items belonging to or originating from third parties (“Third-Party Content”). Such Third-Party Websites and Third-Party Content are not investigated, monitored, or checked for accuracy, appropriateness, or completeness by us, and we are not responsible for any Third-Party Websites accessed through the Site or any Third-Party Content posted on, available through, or installed from the Site, including the content, accuracy, offensiveness, opinions, reliability, privacy practices, or other policies of or contained in the Third-Party Websites or the Third-Party Content. Inclusion of, linking to, or permitting the use or installation of any Third-Party Websites or any Third-Party Content does not imply approval or endorsement thereof by us.

Any notice alleging that materials hosted by or distributed through the Site infringe intellectual property rights must include substantially the following: an electronic or physical signature of the person authorized to act on behalf of the owner of the right being infringed; a description of the intellectual property that you claim has been infringed; a description of the material that you claim is infringing and where it is located on the Site; your address, telephone number, and email address; a statement by you that you have a good faith belief that the use of the materials on the Site of which you are complaining is not authorized by the intellectual property owner, its agent, or the law; and a statement by you that the above information in your notice is accurate and that, under penalty of perjury, you are the intellectual property owner or authorized to act on the intellectual property owner’s behalf.

TSF’s intellectual property policy is to: (i) remove or disable access to material that TSF believes in good faith, upon notice from an intellectual property rights owner or his or her agent, is infringing the intellectual property rights of a third party by being made available through the Site; and (ii) in appropriate circumstances, to terminate the accounts of and block access to the Site by user who repeatedly or egregiously infringe other people’s copyrights or other intellectual property rights.

7. MODIFICATION OF THESE TERMS OF USE

We reserve the right to change these Terms of Use on a going-forward basis at any time. Please check these Terms of Use periodically for changes. If a change to these Terms of Use materially modifies your rights or obligations, we may require that you accept the modified Terms of Use in order to continue to use the Site. Material modifications are effective upon your acceptance of the modified Terms of Use. Immaterial modifications are effective upon publication. Disputes arising under these Terms of Use will be resolved in accordance with the version of these Terms of Use that was in effect at the time the dispute arose.

8. TERM AND TERMINATION

THESE TERMS OF USE SHALL REMAIN IN FULL FORCE AND EFFECT WHILE YOU USE THE SITE. WITHOUT LIMITING ANY OTHER PROVISION OF THESE TERMS OF USE, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SITE (INCLUDING BLOCKING CERTAIN IP ADDRESSES), TO ANY PERSON FOR ANY REASON OR FOR NO REASON, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY REPRESENTATION, WARRANTY, OR COVENANT CONTAINED IN THESE TERMS OF USE OR OF ANY APPLICABLE LAW OR REGULATION. 9. EFFECT OF TERMINATION

Upon termination of these Terms of Use: (i) your license rights will terminate and you must immediately cease all use of the Site; and (ii) the Sections titled Eligibility, Intellectual Property Rights, Feedback, Third Party Websites and Content, Effect of Termination, Governing Law and Jurisdiction, Disclaimer, Privacy Policy and Miscellaneous will survive.

10. GOVERNING LAW AND JURISDICTION

These Terms of Use and your use of the Site are governed by and construed in accordance with the laws of the State of California applicable to agreements made and to be entirely performed within the State of California, without regard to its conflict of law principles. The exclusive place of jurisdiction for all disputes arising from or in connection with this agreement is San Francisco County, California, or the United States District Court for the Northern District of California and our dispute will be determined under California law.

THE SITE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SITE AND OUR SERVICES WILL BE AT YOUR SOLE RISK. Our failure to exercise or enforce any right or provision of these Terms of Use shall not operate as a waiver of such right or provision. INFORMATION YOU PROVIDE TO US.

You can unsubscribe from our promotional emails via the link provided in the emails. Please note that, even if you opt out of receiving promotional messages from us, you may continue to receive administrative messages from us.

INFORMATION WE COLLECT WHEN YOU USE OUR SITE.

Location Information. When you use our Site, we may receive your precise location information and/or infer your general location information, for example, by using your IP address. 3. WILL YOUR INFORMATION BE SHARED WITH ANYONE?  
We may share or transfer your information for a variety of purposes, as described below.

Vendors, Service Providers, Contractors, and Agents. We may share the information we collect with third party vendors, service providers, contractors and agents who perform services for us or on our behalf, such as email delivery, hosting services, and/or customer service.  

Analytics Partners. We use analytics services, such as Google Analytics, to collect and process certain analytics data, such as the device and usage data described above. You can learn about Google’s practices by going to https://www.google.com/policies/privacy/partners/, and opt out of them by downloading the Google Analytics opt-out browser add-on, available at https://tools.google.com/dlpage/gaoptout. 

Trust & Safety Professional Association. We may share the information we collect, such as your name and email address, with the Trust & Safety Foundation Association, for purposes such as sending promotional materials that may interest you.

Merger, Sale, or Other Asset Transfers. We may transfer your information to service providers, advisors, potential transactional partners, or other third parties in connection with the consideration, negotiation, or completion of any merger, sale, acquisition, liquidation, or transfer of all or a portion of our organization or assets. 

As Required by Law or Similar Disclosures. We may access, preserve, and/or disclose your information if we believe doing so is required, necessary, or appropriate to: enforce our Terms of Service or other legal rights; respond to legal requests; comply with applicable laws and regulations; protect your, our, or others’ rights, property, or safety; or otherwise to prevent harm.

4. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

7. CHILDREN  

We do not knowingly collect, maintain, or use personal information from children under 13 years of age, and no part of our Site is directed to children. If you learn that a child has provided us with personal information in violation of this Privacy Policy, you may alert us at admin@tspa.info.

8. INTERNATIONAL USERS

Our Site is hosted in the United States. If you choose to use our Site from the European Union or other regions of the world with laws governing data collection and use that may differ from U.S. law, please note that you are transferring your personal information outside of those regions to the United States for storage and processing. Also, we may transfer your data from the United States to other countries or regions in connection with the storage and processing of data, fulfilling your requests, and operating our Site. By providing any information, including personal information, on or to our Site, you consent to such transfer, storage, and processing.
